Overtime Law

The Minnesota Fair Labor Standards Act requires employers to pay employees over time after 48 hours per work week. However the Federal Fair Labor Standards Act requires employers that produce or handle goods for interstate commerce, businesses that gross more than $500,000 per year, businesses that were covered before April 1, 1990, and specified other businesses (hospitals, nursing homes, public schools, etc.) pay employees overtime after 40 hours per work week.

Overtime rate of pay is considered to be one and one-half the employees’ regular rate of pay. According to both state and federal laws overtime pay is mandatory, however some employees are exempt from overtime wages. These include (but are not limited to) executives or other professionals who have salary requirements, retail or service employees paid on commission, and outside sales professionals.

The payment of overtime hours is mandatory regardless of the businesses size, method of compensation, or designations. If you have earned overtime hours and your employer has refused to pay you, you may need legal counsel to aid you in receiving your money.
