Qui Tam Claims

Qui Tam claims are a provision of the False Claims Act. This time lawsuit is placed against individuals and/or companies that have been defrauded by the government. This includes employees who have information about their company submitting false claims for payment from the federal government.

Due to the delicate nature of Qui Tam claims, and false claims in general, false claims lawsuits are unavailable to the public and cannot be discussed with anyone except government officials. Defendants are also not told about the pending investigation or lawsuit. This seal lasts for sixty days, however seals can be (and usually are) extended while the government investigates.

If the government investigation results in the finding of false claims, the defendant must pay three times the amount of the governments loses plus a fine for each claim. Whistle blowers are also rewarded 15 to 30 percent of whatever the government receives as a result of the lawsuit.
